Friday 20th September 2013 was a sunny day in Sacramento as a small band of supporters including Kathleen Conti assembled outside the offices of Governor Brown at the California State Capital.

Despite being few in number, nobody was likely to miss them as they stood proudly with their signs and fluorescent pink and yellow t-shirts.

They were there to voice their backing of the “California Victims’ Act,” or SB 131 as it is otherwise known. If signed, the bill will extend the Statute of Limitation in California for certain childhood sexual abuse victims over the age of 26.*

Also outside Governor Brown’s office to show his own support for the bill was lawyer Irwin Zalkin. For more than two years Irwin has been representing Jehovah’s Witness survivors of childhood sexual abuse.

Though Irwin is an experienced lawyer, he has been on a steep learning curve as far as Jehovah’s Witnesses are concerned. Prior to taking on the first Gonzalo Campos case in 2011 he had never been involved in suing Watchtower. That case settled for a “significant” but undisclosed amount (out of respect for the victims’ privacy) – but with hindsight, Irwin was only just getting started.

Irwin’s firm is currently handling no less than eleven lawsuits against the Watch Tower Society across six States. Seven of those have already been filed and are making their way through the courts. Four further cases are due to be filed, and Irwin expects that several more will come forward shortly.

I called the Zalkin Law Firm offices yesterday scarcely able to believe things were really this bad for Watchtower. Kathleen Conti had already told me of Irwin’s glut of lawsuits following her conversation with him during the rally, but I needed to hear this for myself. Irwin was not only kind enough to take my call and confirm what he told Kathleen – he also summarized the actions he is pursuing against the Watchtower. Here follows some information on the complaints filed (or which are planned for filing)…

  • J.L. – California – a seventh victim of Gonzalo Campos who was abused when he was eight years old at the Linda Vista Spanish congregation in San Diego, California in 1986. His mother complained to the elders and Campos was privately reproved. Shocked by the lack of action, the victim’s mother immediately left the congregation with her son. By this stage Campos was a known predator with complaints having been made to the elders at Linda Vista Spanish, Playa Pacifica Spanish and the Watchtower dating back to 1982.
  • Elizabeth McFarland – Ohio – a former ministerial servant named Scott Silvasy sexually molested Elizabeth when she was a child through her early teens. She reported it to her parents when she was a teenager. Her parents reported it to the elders at the West Congregation in Lorain, Ohio. The case was not reported to police. Silvasy committed suicide on Elizabeth’s birthday. There had been a prior complaint against Silvasy. (Click here for complaint form)
  • Monica Lynn Jaramillo – New Mexico – Monica Lynn was abused by Mike Brunner who had also abused her mother when her mother was a minor. In 1986 Monica’s mother told the elders of the Los Lunas Congregation in New Mexico of her abuse by Bruner, who was an elder at Los Lunas in 1986. They told her that she needed to spend more time in service, and needed to forgive him because Jehovah would not have made him an elder if he had not repented. To show her forgiveness she needed to leave her children under his supervision. He raped Monica Lynn on one of those occasions.
  • J.W. – California – J.W. was sexually abused by a serial pedophile who was an elder in her Southern California congregation. He abused several girls at a sleep-over party including J.W., and was subsequently criminally convicted for the abuse. (Click here for complaint form)
  • T.L. – California – T.L. was abused by Brent Dalluge, a ministerial servant in the Fountain Valley Congregation in Southern California. In 1992 Dalluge was disfellowshipped after admitting to sexually abusing almost a dozen children. Dalluge confessed to drugging some of those boys to accomplish the abuse.
  • T.O. – Washington – T.O. was in the Hazel Dell Congregation in Vancouver, Washington where she was abused by several older JW boys, one of whom was the son of a prominent Elder. The elders were informed of the abuse but refused to believe the report, and T.O. continued to be molested by the same boys. One of the boys was subsequently arrested for molesting several young girls. (Click here for media report on the case)
  • O.P. – California – an eighth victim of Gonzalo Campos formerly of the Playa Pacifica Congregation in San Diego. O.P. was abused by Campos while he was still an elder. This case has not yet been served.
  • Zalkin also represents victims of abuse within the Jehovah’s Witness religion in Connecticut and Utah, as well as two additional cases in California that have not yet been filed.

As you can see, not all of the above victims have been named publicly. One in particular is still a minor, and any media exposure at this stage would make an already traumatic ordeal only worse for her parents. But what they each have in common is that they have all been failed by Watchtower’s serious and systemic mishandling of child abuse, which is now resulting in significant legal pressure being brought to bear on the organization.

And we are not talking about just a few isolated cases. This is no flash in the pan. Not just the number of lawsuits but the fact that they are spread across multiple US States indicates that mishandling of child abuse is “rampant among Jehovah’s Witnesses” (to quote Rick Simons), with negligent oversight by Watchtower leadership a common denominator.

It can now be beyond any reasonable doubt that Watchtower has a serious child abuse problem of epidemic proportions on its hands. If you live in the United States and your own state is not highlighted on the above map, there’s a good chance this is only because there are cases local to you that have not yet come to light.

Nothing has changed

And JW parents shouldn’t be fooled into thinking this is all in the past and their children are now safe. In October 2012 this website reported on Watchtower’s latest reactionary changes to their under-fire child abuse policies, as introduced in an October 1st letter to elders. The changes merely cemented Watchtower’s self-proclaimed total jurisdiction over matters of child abuse, making it impossible for local elders to notify authorities or warn other parents in the congregation without Watchtower approval.

The letter, which Watchtower legally threatened for publishing, also confirmed Watchtower’s refusal to let go of the now-notorious “two witness rule,” which means that child abuse is not recognized as having been perpetrated unless witnessed by someone other than the victim.

One minor loophole to this rule allows for an abuser to be disciplined if he is accused by more than one victim, but this provision reduces the first victim to mere collateral in the evidence-gathering process. No consideration is given to the fact that one child abuse victim is one child abuse victim too many.

A bill worthy of support

It is not hard to look back on the Candace Conti victory of June 2012 as a real turning point. Since then the floodgates have opened on Watchtower as far as child abuse lawsuits are concerned. Victims keep streaming forward, confident that justice will be served despite the years that have elapsed since their abuse took place.

And if the SB 131 bill is signed by California’s Governor Brown, there is no telling how many more cases will follow. The Statute of Limitations, especially in States like California, has so far been a major hurdle in allowing victims to pursue justice. “We’ve had to turn away many cases because they don’t fit the criteria for the Statute of Limitations,” Zalkin told me. “California has a somewhat difficult Statute for older victims, and we’re trying to get that changed.”

Zalkin further revealed that, if the bill gets the green light and the Statute of Limitations is increased, additional lawsuits may be possible. “There may be several JWs who we’ve talked with that would fit within that new limitations period if the bill becomes law.”

Devoid of accountability

Apart from the Statute of Limitations, another roadblock to successfully suing Watchtower in certain States has been the organization’s evasive tactic of washing their hands of responsibility for victims when cornered in the courtroom. This strategy has already been deployed in Watchtower’s Candace Conti appeal, in which they are arguing that there was no “special relationship” between the organization and Candace.

“They’ve had some successes in some States like Minnesota that have found that there was no duty owed by the Watchtower,” explained Zalkin. “We have beat that argument consistently because we’ve done a lot of digging into how the organization functions. If you don’t really know this organization, you can get fooled by the way they present their argument. We’ve been able to show how hierarchical it is and the level of control that is exercised by the Governing Body on every aspect of a JW’s life.”

It is reassuring to know that, despite Watchtower’s efforts to dodge responsibility for their own young “sheep” over whom they claim to be “shepherds,” lawyers like Irwin are persistent and studious enough to make sure the legal system isn’t duped.

Even so, it is alarming to think that so many Witness parents place such implicit trust in Watchtower to care for their children’s interests through the elder arrangement, when Watchtower is only too pleased to bail out through their cunning men in suits the moment things turn sour.

A bleak outlook

With Watchtower already stricken financially, as evidenced by their global downsizing initiative, there is no telling how catastrophic the impact of these new lawsuits could prove to be on the organization’s long-term future.

The multi-million dollar Candace Conti case is still in its appeal phase, and Zalkin has now filed seven lawsuits with four pending – and all this after the sizeable settlement he secured in his first case against the Watchtower in 2011.

Even if SB 131 is not passed, the current lawsuits alone could prompt further victims to step forward, such is the serial nature of pedophilia. As Zalkin explained, “These things have a tendency to mushroom. We started out with one Campos victim, and it turned into seven, and there’s going to be an eighth.”

The organization’s financial plight thus appears far from rosy as it looks to bankroll the continued fall-out from its own negligent policies. Don’t be surprised if the Governing Body‘s cries for donations reach fever pitch in the weeks and months ahead.

Clear and present danger

Also at Kathleen Conti’s side for last week’s rally was one of Zalkin’s clients who will directly benefit from SB 131 if it is passed.

John Kirby is now an adult, but he was left emotionally scarred by the abuse he suffered as a young Witness boy, for which he has a signed confession from his abuser.

Under the current law, John is too old to pursue justice for what happened to him. He is therefore throwing his support behind SB 131 in the hopes that this important legislation will give him his long-overdue day in court.

In a conversation with John last night he chillingly told me, “My abuser is still actively hanging with young boys in the congregation and taking them out in service.” If this doesn’t clearly demonstrate that the threat to young Witness children is clear and present, I don’t know what does.

*SB 131 will also open a one year window for victims who were over the age of 26 but were unaware of the causal relationship between their childhood sexual abuse and adult psychological problems in 2003 when California extended a similar one year window.

    I’m going to play watchtower (devil)’s advocate here for a second.
    When I was a child (not JW), a neighbor molested my sister and me. I told my mom about it (she asked), and she did nothing. This haunts her still today. She is now a JW.

    When I mentioned the Candace Conti lawsuit to my JW mother, and told her that the WTS was going to have a to pay a huge settlement, her response was:
    “With millions of dollars being rewarded, Of Course more people are coming forward.”


    All I actually said was, “That’s YOUR money.”

    It’s interesting that Watchtower is now having it’s traveling reps during their next cong visit ask elder bodies if they suspect there to be any sexual abuse predators in their congregation. And then the process of informing WT and then informing parents in the cong.

    11 law suits, that could result in damages exceeding 100 Million Dollars. Sounds to me like the waters of Babylon are receding…

    Mercy, mercy me. How many more victims do there need to be before those wretches, the so called Governing Body, finally enforce a moral and ethical child protection policy?

    This scandal is now becoming more and more exposed. Sites such as this one broadcast the truth about this moribund religion. Its days are numbered. The storm is coming and it will raze them to the ground.

    I am pleased to say that Society has evolved beyond their narrow view of justice. No one finds it acceptable to fail to notify the authorities about cases of child abuse. No one.

    My heart goes out to the victims and their family and friends. I hope that justice will be served, and that they are able to move on in their lives to fully become the wonderful people they are.

    Thank you Cedars for taking the time to put this article together. SB 131 will provide a level of justice to Jehovah’s Witnesses in California that were not and continue not to be protected by the organization as children. The WTS continues to only use the authorities when it benefits their interest.

    Its about time for the words of Gal 6:7 to come upon the Watchtower for their sowing of arrogance in regard to a flawed policy on reporting Child Abuse. They deserve every and anything that may come their way including the downfall of this 130 yr old Cult Religion that has claimed so many victims. To Bad To Bad for the time has come for you to answer for your errors. Does this really sound like Gods spirit directed organization? Oh my you couldn’t be further from the real truth. Your Ways have been exposed over and over again. May God grant peace to these poor victims for all that they have suffered by the hands of the Watchtower.     Further evidence to prove how detrimental this hierarchical arrangement is as shown in the Nov. 15, 2013 issue of Watchtower where it insists that rank and file follow instructions from the governing body even if it makes no sense to them. Wouldn’t it be grand to see this used in court against this immoral group!

    11 is a nice number, but we all know at Bethel they have a list of over 20,000 brothers who have been accused of sexual abuse of minors. Those are just the accused; there’s no doubt thousands more children who suffer in silence or whose parents won’t even approach the elders out of fear or who are so staunch in protecting the JWs that they don’t believe it or won’t report it.

It is to be noted, also, that during the past year, 36,638 individuals had to be disfellowshipped from the Christian congregation, the greater number of them for practicing immorality

    Our family as Jehovah’s Witnesses attended 3 different congregations. We find out there were pedophiles in all three here in Eastern Canada. Sad state of affairs for a charitable religious organization who is really just a publishing/real estate company.

    I was abused as a child in the early 70’s. Its made me question the truth and when 1975 came and the new order did not come I lost my faith but I was still a child. I did not report it to my Mother and Father let alone the elders, I was to ashamed, I was 8 years old. Back then the Kingdom Hall meetings spoke of adult subjects to children along with all that end times nonsense. The guilt I felt drove me to despair and destroyed my childhood if you don’t count all the either destructive teachings they crammed down your throats.
    My folks would have thrown me on a fire if the Governing Body told them to do so. I was never baptized and in 1981 when I graduated from I left home only to become disassociated just for leaving, new rules. I never had a relationship with my family and have suffered for most all my life for a chose my parents made to become Jehovah’s Witness that was made before I was born.
    I am thankful for your website and others. It appears that the Wash towel may see its own Armageddon and the sooner the better. This will drag through the court for years and more children will be harmed by their policy’s concerning child abuse but their teachings will harm ALL those children so unlucky to be born into this mind control cult. If my parents live long enough to see this cult die it will kill them. As my mother said a few years ago ” Of course its the truth, look at all we have sacrificed” I was and am a sacrifice unto Jehovah and so is any child of a Jehovah’s Witness. To be a child of a Jehovah’s Witness is child abuse. I look forward to filling out the survey. Thanks

    How will next year’s Watchtower mags look? The bosses’ orders to their flock to avoid the internet and contact with apostates are not working. It is clear that a huge number of JWs worldwide, including a growing crowd from Africa, the cult’s only growth region, are now aware of the mass of websites, Facebook pages and Youtube vids, exposing the evils of the cult.

    If they disfellowshipped all those who accessed the ‘wrong’ info., the numbers of active JWs would drop overnight. What can the bosses do, save shout more loudly and desperately? As these current court cases hit the headlines, the door knocking round will become even more disheartening. JW bosses, local, national and global will be hassled regularly by the press. Can they keep hiding and hoping their anodyne press releases and statements will satisfy anybody? AAWA is now one step ahead of the media when it comes to local press reports on happy, smiling and polite JWs at assemblies.

    The two thirds dropout rate of born in JWs can only increase, adding to the army of JW ‘expositors’. We can but hope that the implosion of that awful old cult will only gather pace, notwithstanding long drawn out court cases and appeals, and that the Zalkin cases here headlined will be a major factor in hastening the End of that misery making End Times cult.

    Fantastic piece of journalism, I applaud you for your diligent research, and sparing no expense for phone call interviews. I am sure I read somewhere you are from the UK. Please correct me if I am mistaken.

    Like it is mentioned earlier, I am concerned for the young JW children who are being abused as we speak. Poor young souls may be praying their hearts out to Jehovah during their abuse, waiting for him to answer them and stop it. How many more victims are there going to be

    Thank you 70wksofyrs. I am sure that it sounds raw, I have hided what happened to me even from my wife for 25 years. I tried to forget but after stumbling across this site 6 months ago and learning that I was not the only one, it all came back as if it were yesterday. I am seeing a therapist over this very issue right now. There’s a lot of damage but it all makes sense to my wife now so in that way thing can only get better
    As a child I felt that it was my fault that I was sexually abused by a witness and with all the guilt of displeasing Jehovah, I knew that as an 8 year old I was going to the lake of fire. Real head trip, then my parents did noting to prepare me for the real life then disowned me at 18. To have only been sacrificed to Moleck at the age of 2. Bitter? Little bit but when I think of all the other helpless and hopeless children right now who are going through what I went through and then later will go through it breaks my heart.
    If there is a God he needs to stop them but if there is not God then we must stop them. Funny it will be through the courts but even if it all end today the line of damaged people will be in the millions. Thank You

    A thinking person would have expected the much anticipated Annual Meeting to have addressed real issues affecting the flock. For instance, the major real estate sales and what will be done with the proceeds.
    Also, you would think they’d address these lawsuit concerns in a legitimate fashion.
    Do they really keep thinking witnesses won’t read news online? Maybe some stay in their bubble, but not all.
    The child abuse cases are what finally got me searching online.

    Es ist herrlich zu hören,dass dieser ZJ Verein endlich auch angeprangert wird bei den Gerichten.Die armen Kinder sollten ihre falsche Scham aus ihren Köpfen verbannen und sie ermuntern jeden anzuzeigen der sich einem Kind Sexuell genähert hat . Man trägt das sein ganzes Leben mit sich rum und erst wenn man darüber ganz offen spricht und nichts verbirgt wird man frei…Wir waren auch hier in D in einer Versammlung wo ein Ältester schon lange Jahre mit seiner Tochter 3 Kinder hat . aber wir haben nichts zu hinterfragen ,sagte man uns und eckelte uns hinaus .Heute sind wir frei und leben ohne Druck . Lb. Grüße an alle die sich in der Sache für die geschädigten Kinder einsetzen und möge unser Himmlischer Vater euch alle Segnen

    For me the bit that just makes my gut churn is that none of the people who have suffered abuse have had a voice from the GB,they really don’t want to confess to anything wrong,even the Catholic Church has said sorry!
    Millions of dollars don’t get awarded on a whim to victims,doesn’t the GB get that! The victims who have been compensated are not lying otherwise how are they winning?
    I seriously doubt that it’s all fabrication!
    And in the meantime not even a sorry,their arrogance is monumental!

    hollo leider kann ich kein Englisch,aber hier in Deutschland schlafen die Leute, besonders die Schafe in den Versammlungen. Hier wird alles extrem Vertuscht und verschleiert. ich selbst bin von der Versammlung gegangen ,weil i.der Versammlung ein Fall von Kindsmissbrauch ist und bis heute noch der Opa Ältester ist. Man hat uns hinaus geeckelt .Aber wir wollten mit dem Verein nichts mehr zu haben ,weil das nicht richtig ist ,dass es nicht der Polizei gemeldet wird. Aber ein Ältester ist bei der Polizei,der hat es auch vertuscht . Was soll man da noch machen ,wenn in der Versamlung die Polizei schon nichts tut… Wir sind machtlos wenn die Herren Älteste sind und noch bei der Polizei …die machen den Leuten Angst und halten zusammen und sagen gegen dich aus und lügen u. lügen ….wir haben keine Chance gegen 3Mann Älteste und Dienstamtgehilfen.Die Org. hat die besten Anwälte was sollen wir da machen ,wenn sie uns bedrohen ???

    He,die Org. ist ein gerisserner Verein und versteckt sich hinter der Bibel – was ein kraus …alles im Namen Gottes und Jehova wird es schon richten …Die Ältesten werden geschult mit ihren Pionieren in den Versammlungen zu spionieren, wer z. B ein Buch von R. Franz hat und was im großen und ganzen intern in den Vers. gesprochen wird… Schafe die zu viel wissen werden ignoriert,gemobt und aus fadenscheinigen Gründen entfernt u. als Atrünige abgestempelt. Die 2 zeugen- regelung ist eine Frechheit.Ein kind das missbraucht wird von einem Ältesten muss 2 Zeugen bringen,unglaublich ist das…Die Org. braucht das Geld von den Schafen nur um ihre Pedophilen raus zu boxen bei Gericht . Die armen dummen Schafe dürfen in kein Internet um nicht zu erfahren ,was in den Medien über die Zeugen und gesagt wird,und die prozesslawine in Amerika rollt u.rollt, den alles was verborgen wird ,wird offenbar werden ,so steht es schon in derhl.     I hope Watchtower will loose from all of this cases so that they will cease to exist on the face of this earth. They have been misleading so many people.
